Most Salmonella Enteritidis recalls in shell eggs don't come from a single bad batch. They come from a gap somewhere in a prevention system that federal law has required for over a decade. That's the lesson worth sitting with before we get to any specific recall: the rule already exists, it's specific, and it's been tested against outbreak data since 2010. When a recall happens, the question isn't "how did Salmonella get into eggs." Salmonella Enteritidis can live inside a healthy-looking hen's ovaries and end up inside an egg before the shell ever forms. The real question is which part of the required prevention plan wasn't doing its job.

In late July 2026, Midwest Poultry Services, L.P. recalled 1,589,577 dozen white and brown cage-free shell eggs produced at its Texas facility over possible SE contamination, according to the FDA recall notice. I'm not going to walk through the recall mechanics here — that's covered in the agency's own posting. What I want to do is show you the regulatory system that's supposed to prevent exactly this outcome, why it's built the way it is, and what a producer's quality system needs to look like to actually satisfy it, not just look compliant on paper.

The Rule That Governs Shell Egg Safety: 21 CFR Part 118

The controlling regulation is 21 CFR Part 118, formally titled "Prevention of Salmonella Enteritidis in Shell Eggs During Production, Storage, and Transportation." FDA finalized it in July 2009 after decades of SE-linked outbreaks tied to shell eggs, and it phased in on two compliance dates: July 9, 2010 for egg producers with 50,000 or more laying hens, and July 9, 2012 for producers with 3,000 to 49,999 hens. Operations with fewer than 3,000 laying hens are exempt, as are eggs that go straight to a pasteurization or other SE-elimination treatment before reaching consumers as shell eggs.

The rule sits outside the newer FSMA Preventive Controls framework because shell egg production at the farm level is treated as a raw agricultural commodity activity, not a manufacturing operation under 21 CFR Part 117. That distinction matters for compliance planning: a producer can be fully compliant with Part 117 elsewhere in its operation and still be independently on the hook for Part 118 at the layer house. In my experience advising food producers, this is one of the more common gaps I see — teams build a strong FSMA preventive controls program and quietly assume it covers the egg-specific rule too, when Part 118 has its own separate testing triggers, recordkeeping, and refrigeration standard that a generic food safety plan won't automatically satisfy.

What an SE Prevention Plan Actually Has to Cover

The operative section is 21 CFR 118.4, and it requires a written SE prevention plan built around a specific set of controls, not general good practice. Producers have to address biosecurity (controlling who and what moves onto the farm and between poultry houses), a rodent and pest control program (rodents are a well-documented SE reservoir and transmission route), cleaning and disinfection of poultry houses between flocks, environmental and egg testing for SE, refrigeration of eggs at or below 45°F beginning 36 hours after the time of lay, and a written plan tying all of it together with records a producer can produce on request.

Each of those pieces is checking a different failure mode, and that's worth understanding because it explains why the rule is structured the way it is rather than just mandating "test the eggs."

Two of those rows deserve extra attention because they're where I most often find real-world compliance gaps.

Environmental Testing Is the Trigger, Not the Whole Program

Producers are required to test the environment of each poultry house for SE starting at 40 to 45 weeks of the flock's age, and roughly every four to six weeks after that for the life of the flock. If that environmental test comes back positive, the producer must then test eggs from that house — typically four sets of 1,000 eggs collected over consecutive two-week periods — before those eggs can be sold as shell eggs without further restriction. Until the egg testing clears the house, eggs from that environment have to be diverted to pasteurization or another treatment that destroys SE.

This is the part of the system that most directly prevents a recall like the Texas one from reaching consumers. A producer with a genuinely functioning environmental testing calendar and a real diversion protocol for positive results doesn't ship untreated eggs from a contaminated house. When shell eggs with SE potential do reach retail shelves at the volume seen in this recall, the honest question for the producer's quality team is whether the environmental testing schedule was actually being run on time, whether the lab results were reviewed and acted on promptly, and whether the diversion-to-pasteurization step was actually enforced when a test came back positive.

Refrigeration Is a Control, Not a Suggestion

The 45°F requirement isn't a storage best practice tacked onto the rule. Salmonella Enteritidis multiplies inside an egg at ambient temperatures well above refrigeration, and the 36-hour window is calibrated to how quickly bacterial load can climb from a low, largely harmless level to an infectious dose. A producer can have a clean environmental testing record and still create a food safety hazard through a refrigeration lapse in the packing or transport chain — which is exactly why the rule treats temperature control as an independently enforceable requirement with its own recordkeeping expectation, not a downstream detail left to distributors' discretion.

Where Prevention Breaks Down

Recalls at this scale are rarely the result of one missed step. They're usually the compounding effect of a testing schedule that slipped by a few weeks, a positive environmental result that didn't trigger the required egg testing and diversion fast enough, or a records system that couldn't answer FDA's questions quickly when an inspector or an epidemiological investigation came asking. The Centers for Disease Control and Prevention estimates that Salmonella causes roughly 1.35 million infections, 26,500 hospitalizations, and 420 deaths in the United States every year, and eggs remain one of the food categories most consistently linked to SE illness clusters despite fifteen years of the federal prevention rule being in force. FDA's own projection when it finalized Part 118 was that full implementation would prevent approximately 79,000 illnesses and 30 deaths annually tied to SE in eggs — a number that only holds if the prevention plan on paper matches what's actually happening in the poultry house.

I've reviewed enough SE prevention plans to say this plainly: the plans that fail an FDA inspection almost never fail because the written document is missing a required section. They fail because the testing dates in the plan don't match the lab invoice dates, because the cleaning and disinfection logs have gaps between flocks, or because nobody can produce the biosecurity sign-in sheet from the week an inspector asks about. The document exists. The evidence that it was followed does not.

Compliance Timeline and What's Changed Since 2010

The core compliance dates are settled and haven't moved: large producers (50,000+ hens) since July 9, 2010, and smaller producers (3,000-49,999 hens) since July 9, 2012. What has shifted is enforcement posture. FDA has continued to bring Part 118 into its routine farm inspection rotation, and egg producers should expect environmental and egg testing records, refrigeration logs, and biosecurity documentation to be the first things an investigator asks for during both a routine inspection and any recall-triggered follow-up. A producer's compliance obligation doesn't end at having a plan — 21 CFR 118 also requires records be kept for at least two years and made available to FDA within 24 hours of a request, which is a tighter turnaround than many smaller operations are actually staffed to meet on short notice.

Practical Compliance Guidance for Producers

If you're running a layer operation at or above the 3,000-hen threshold, here's where I'd focus a self-audit before FDA does it for you.

  • Put the environmental testing calendar on a real tracking system, not a paper file in a drawer. Every house needs a testing date tied to flock age, and every result needs a documented sign-off with a named responsible person.
  • Build the egg-testing and diversion protocol as a hard stop, not a judgment call. If an environmental test comes back positive, the eggs from that house should be routed to pasteurization automatically until the required four-round egg testing clears, with no exception path that depends on someone remembering to flag it.
  • Validate refrigeration continuously, not spot-check. Data loggers on cooler units and transport trailers, reviewed on a set schedule, are cheaper than a recall and far cheaper than an outbreak investigation.
  • Treat biosecurity logs as inspection-ready at all times. Visitor logs, dedicated footwear and equipment per house, and rodent control service records should be current enough to hand over the same day they're requested.
  • Run an independent audit of the written SE prevention plan against actual practice at least annually. A plan that was accurate when written two years ago isn't automatically accurate today if flock rotations, house assignments, or vendor relationships have changed.
  • Know your recordkeeping exposure. Two years of retention and a 24-hour production window aren't aspirational — they're the actual regulatory standard, and most operations that stumble here do so because records live in disconnected paper logs rather than a centralized system.

None of this is exotic. It's the difference between a prevention plan that exists and a prevention plan that's operating. That distinction is the entire story behind most SE recalls, including large ones.
